I. General Terms and Conditions
§ 1 Basic Provisions
(1) The following terms and conditions apply to contracts that you conclude with us as the provider Alpha Industries GmbH & Co. KG via the website www.alphaindustries.de. Unless otherwise agreed, the inclusion of any terms and conditions used by you is hereby rejected.
(2) A consumer within the meaning of the following provisions is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity. An entrepreneur is any natural or legal person or legally capable partnership who, when entering into a legal transaction, acts in the exercise of their independent professional or commercial activity.
§ 2 Conclusion of the Contract
(1) The subject matter of the contract is the sale of goods.
(2) By listing the respective product on our website, we already submit a binding offer to conclude a contract via the online shopping cart system under the conditions stated in the product description.
(3) The contract is concluded via the online shopping cart system as follows:
The goods intended for purchase are placed in the shopping cart. You can access the shopping cart via the corresponding button in the navigation bar and make changes at any time.
After clicking the button “Checkout” or “Proceed to order” (or a similar designation) and entering your personal details as well as the payment and shipping conditions, the order data will be displayed to you as an order overview.
If you use an instant payment system (e.g. PayPal (Express/Plus/Checkout), Amazon Pay, Sofort, giropay), you will either be redirected to the order overview page in our online shop or to the website of the respective payment service provider.
Before submitting the order, you have the opportunity to review, change or cancel all details.
By submitting the order via the corresponding button (“order with obligation to pay”, “buy”, “buy now”, “order subject to payment”, “pay” or a similar designation), you declare your legally binding acceptance of the offer.
(4) Your enquiries regarding the preparation of an offer are non-binding. We will submit a binding offer to you in text form (e.g. by email), which you may accept within 5 days, unless a different period is stated in the respective offer.
(5) Order processing and the transmission of all information required in connection with the conclusion of the contract are carried out by email, in some cases automatically. You must therefore ensure that the email address you have provided is correct and that receipt of emails is technically ensured and not prevented by spam filters.
(6) We reserve the right to cancel confirmed orders if the goods are not available or not available in the desired quantity. Any payments already made will be refunded accordingly. Further claims, in particular claims for damages, are excluded.
§ 3 Right of Retention, Retention of Title
(1) You may only exercise a right of retention insofar as it relates to claims arising from the same contractual relationship.
(2) The goods remain our property until full payment of the purchase price has been made.
§ 4 Warranty
(1) The statutory warranty rights apply.
(2) Consumers are requested to check the goods upon delivery for completeness and obvious defects. Failure to do so has no effect on statutory warranty claims.
(3) Deviations from objective requirements shall only be deemed agreed if you were expressly informed of them prior to submitting your contractual declaration and the deviation was expressly and separately agreed between the contracting parties.
§ 5 Choice of Law, Place of Performance, Jurisdiction
(1) German law shall apply. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.
(2) The place of performance and jurisdiction shall be our registered office, provided that you are a merchant, a legal entity under public law or a special fund under public law.
(3) The provisions of the UN Convention on Contracts for the International Sale of Goods (CISG) shall not apply.

2. Information on the Conclusion of the Contract
The technical steps leading to the conclusion of the contract, the conclusion of the contract itself and the options for correction are governed by the provisions under “Conclusion of the Contract” in Part I of these General Terms and Conditions.
3. Contract Language, Storage of the Contract Text
3.1 The contract language is German.
3.2 The complete contract text is not stored by us. Before submitting the order, the contract data can be printed or saved electronically using the browser’s print function. After receipt of the order, the order data, the legally required information for distance contracts and these General Terms and Conditions will be sent to you again by email.
3.3 In the case of enquiries outside the online shopping cart system, you will receive all contract data as part of a binding offer in text form, e.g. by email, which you can print or save electronically.

6. Prices and Payment Terms
The prices stated in the respective offers are total prices and include all price components including all applicable taxes. Shipping costs are shown separately.
For deliveries outside the European Union, additional costs may arise for which we are not responsible, such as customs duties, taxes or money transfer fees, which must be borne by you.
7. Delivery Conditions
Delivery conditions, delivery times and any delivery restrictions can be found in the respective offer.
If you are a consumer, the risk of accidental loss or deterioration of the goods during shipment shall only pass to you upon delivery of the goods.
8. Statutory Warranty Rights
Warranty rights are governed by the provisions under “Warranty” in Part I of these General Terms and Conditions.
